On April 14, 2003, the Privacy Regulations under the Health Insurance Portability and Accountability Act that govern the use and disclosure of protected health information (PHI) went into effect.
The Sparrow Health System Institutional Research Review Committee (IRRC) has a policy that outlines the permitted uses and disclosures of PHI for research purposes entitled:
Use and Disclosure of Protected Health Information for Purposes of Research . In order for an investigator to use or disclose
PHI, the investigator must either: (1) obtain an individual authorization that complies with the requirements of the Policy; (2) document for the IRRC that an authorization is not required in accordance with this Policy, or (3) request a partial waiver of authorization for research screening/recruitment purposes. The use or disclosure of PHI for a research protocol may not begin until written approval (in accordance with this Policy) is provided by the IRRC to the principal investigator.
New subjects to be enrolled in an ongoing or new research project requiring informed consent, after April 14, 2003, must be given an IRRC approved informed consent form and a HIPAA Patient Use and Disclosure Authorization form that complies with the HIPAA policy requirements.
